David Gonzalez faces booking in Fresno following an altercation that left him wounded with a gunshot. Police say the off-duty federal agent assaulted a resident before the homeowner fired a weapon.
Fresno Police responded to a call at 3:20 a.m. Officers discovered 32-year-old David Gonzalez of Texas handcuffed on the ground. He had a gunshot wound to his stomach. Police say Gonzalez appeared intoxicated during the incident.
Investigators found that a resident returned home and saw Gonzalez sleeping on her front lawn. She alerted her 72-year-old father. The father stepped outside to ask Gonzalez to leave, police said.
Gonzalez refused to move. Officers say Gonzalez assaulted the 72-year-old man and forced him to the ground. The daughter intervened. Gonzalez allegedly attacked her as well.
The father then pulled out a firearm, according to police. He shot Gonzalez in the stomach. The daughter’s boyfriend, an off-duty police officer, arrived soon after. He placed Gonzalez in handcuffs.
Gonzalez was taken to a hospital. He is expected to enter Fresno County Jail once treated. In a statement, ICE said the agency is referring inquiries to the Fresno Police Department. Agency officials confirmed Gonzalez was off-duty and alone.
The homeowner will not face criminal charges, Fresno Police said. Investigators confirmed he legally owned the firearm used in the shooting.
Local law enforcement agencies handle physical altercations and self-defense claims through detailed criminal investigations. Detectives gather statements from witnesses and examine physical evidence before submitting findings to prosecutors.
The investigation is ongoing.
