Jazmin Anesi faces felony vehicular homicide charges in Albuquerque following a fatal 2022 hit-and-run incident. Prosecutors shifted their focus to the 20-year-old suspect based on recently tested DNA evidence.
Anesi is charged with homicide by vehicle from reckless driving. She is also accused of knowingly leaving the scene of an accident. Court records show she will appear before a judge later this month.
The collision killed 34-year-old Scott Toole in October 2022. Toole was an Albuquerque father, a marine veteran, an EMT, and a working nurse. He died while underneath his Ford Expedition.
Toole was working on the SUV near Avenida Cesar Chavez and Yale. Jacks held the vehicle up. A PT Cruiser struck the SUV, knocked it off the supports, and killed him.
Investigators initially named 26-year-old Jennifer Rue as the driver. Witnesses told police two other women were inside the vehicle. Authorities charged Rue with failing to report the crash and render aid.
The state dismissed the charge against Rue pending further investigation, according to court documents. The Bernalillo County District Attorney’s office stated it has no plans to refile charges against Rue. DNA evidence later pointed directly to Anesi.
Officers questioned Anesi during an unrelated incident in July of this year. An officer asked, “Would you like to talk to me yes, or no?” Anesi replied, “No I won’t.”
At a memorial service at Hope Covenant Church in Minnesota, family and friends remembered Toole.
“Scott really did make a big difference in this world. From being an EMT, to being a marine serving our country, and being a nurse. And that was his ultimate goal in life was to make a difference and he truly did.”
Charges can be dismissed pending further investigation when new forensic results require additional review. Prosecutors reassign primary culpability if fresh physical evidence links another suspect to the offense. The process ensures formal charges match findings from ongoing lab work.
Anesi remains scheduled to face an Albuquerque judge for her initial court appearance.
