Krystal Garcia granted continuance in Albuquerque fatal hit-and-run trial

Krystal Garcia, a former Albuquerque police officer, asked for a continuance in her fatal hit-and-run trial on Wednesday. Judge Cindy Leos granted the request, pushing the start of Garcia’s trial to November 9 in Albuquerque. The case stems from a May 2025 motorcycle crash on Central Avenue that killed Daniel Trujillo.

Garcia was a passenger on the motorcycle when it struck Trujillo as he crossed the street, according to court filings. Surveillance video captured the motorcycle speeding down Central before the crash.

The driver, former Albuquerque police officer Ezekiel Florez, has already been sentenced to three years in prison. He was the one driving the motorcycle at the time of the crash, prosecutors said.

Both off-duty officers ran from the scene after the crash. Neither called 911 or stopped to help Trujillo, police say.

The crash happened in May 2025. Trujillo was crossing Central Avenue when the motorcycle hit him.

Garcia’s attorney filed an emergency continuance this week. Leos granted it during a short hearing on Wednesday.

The Albuquerque trial will begin November 9. Garcia remains out of custody while she awaits trial.

The Albuquerque Police Department has not commented on the latest schedule change. Records show Garcia is no longer employed by the department.

A trial continuance gives both sides more time to prepare or gather evidence before court begins. The judge weighs the request against the rights of the victim and the public to a timely case. Courts in New Mexico can grant delays for many reasons, including witness availability and new filings.
