New Mexico Supreme Court lets Project Jupiter air permit hearing proceed

The New Mexico Supreme Court has cleared the way for an air permit hearing to move forward for Project Jupiter, a data center under development in Doña Ana County. The justices on Thursday denied a motion to halt the proceedings, according to court records.

The New Mexico Environment Department had scheduled a permit hearing for October, but the date was moved to September 14. Two advocacy groups, New Energy Economy and the Center for Biological Diversity, asked the Supreme Court to pause the hearing.

The court had paused the proceedings last month. Thursday’s order lifted that pause, allowing the hearing to proceed.

The original September 14 hearing date has passed. It is not yet known when the hearing will be held.
